Here’s the real art... the guy who ate the banana will no doubt be arrested and charged. However, because the “artist” did not alter the banana from its natural state, and only used duct tape to secure it to a wall, the Courts will have to decide if this is A. A $120,000 piece of art, or B. A 12 cent banana and 2 cents worth of duct tape.
Because the artist did nothing but tape a banana to a wall, did that act alone alter the value of the banana?? I believe that the Courts will say “No”, it did not. The reason will be that if you set a precedent that an “artists” actions with an ordinary object give it greater value than a non-artist performing the same action with the same object, then you would create two legal classes of people, artists and non-artists.
In this case, the banana eater will be convicted of petty theft and ordered to pay back the 14 cent total valuation, and a small fine.
Via this act of eating the banana, the perp has forced the art world to see what a bunch of idiots they are. The “buyer” can try to sue the gallery for a refund (won’t happen), and the gallery can try to convince a jury in a civil tort against banana eater man that this banana was worth $120k because some guy touched it (but that also is not going to happen).
